Application of the Status of Limitations in Land Disputes in the State Administrative Court

Land disputes in Indonesia frequently arise due to the issuance of State Administrative Decisions that cause legal harm, such as overlapping land certificates, multiple ownership claims, and administrative errors in land registration. This study employs normative juridical and empirical methods with a qualitative descriptive approach. The findings indicate that the statute of limitations in land disputes should not merely be understood as a formal time restriction but also as an instrument to achieve legal certainty, justice, and legal benefit. The calculation of the filing period begins when the aggrieved party becomes aware or reasonably should have become aware of the disputed administrative decision. Furthermore, the filing period is more appropriately interpreted as 90 working days in order to ensure effective legal protection and access to justice.
